DEPARTMENT SUMMARY
The Government Relations team advocates for immigration-related legislative, regulatory, and policy reforms before Congress and the executive branch, consistent with AILA's principles and priorities. The Government Relations team tracks the development of law, policy and practice and prepares and shares resources and information with AILA members.
THE OPPORTUNITY
The Business Litigation Attorney will work closely with the American Immigration Council and AILA's high-impact litigation committee to develop, file, and oversee federal litigation and other legal strategies for AILA. This role will require an experienced attorney to lead a national effort to challenge current Federal policies and practices on employment-based immigration issues. The role may also, at times, handle other immigration issues, such as challenges to family-based immigration and student visa policies and practices. The focus will be on impact litigation on issues in the business/employment-based immigration field. The Business Litigation Attorney will draft and review pleadings and may be required to appear in court. The Business Litigation Attorney works to implement AILA's mission by promoting greater accountability and transparency in the immigration realm through litigation and advocacy.
The Business Litigation Attorney will help lead AILA's employment-based immigration litigation efforts through collaborative work with AILA staff, the American Immigration Council staff, AILA members, other litigators, coalition partners, and open government organizations.
ESSENTIAL JOB FUNCTIONS
• Collaborate and coordinate with the American Immigration Council and serve as a strategic thought partner. This role is the staff contact for the AILA High Impact Litigation Committee, to explore and, where appropriate, undertake affirmative federal court litigation to challenge problematic or improper federal and agency policies and practices.
• Create and implement systems for monitoring and keeping AILA members aware of ongoing business immigration cases.
• Assist with fact investigation and collection of declarations and other evidence in conjunction with federal court litigation.
• Build relationships with key AILA and American Immigration Council stakeholders in the employment-based immigration community to further litigation opportunities.
• Prepare and deliver public presentations and written publications on litigation issues and opportunities.
• Prepare practice materials and litigation resources to immigration practitioners and mentor AILA members pursuing their own litigation efforts.
• Provide legal assessment to the AILA amicus committee and Council legal department on business-related amicus briefs. May contribute research and writing such briefs.
• Support AILA and the American Immigration Council's administrative and legislative advocacy related to business immigration issues.
Job Requirements: • REQUIRED EDUCATION AND TRAINING
• Juris Doctorate (J.D.) degree. At least 7 years of experience as a practicing attorney, which includes 3-5 years of Federal court litigation experience, with an emphasis on Administrative Procedure Act litigation. A specific focus on employment-based immigration law is preferred. Exposure to the government or non-profit settings is a plus.
• OTHER REQUIREMENTS (e.g., language requirement, license requirement, certifications)
• Membership in good standing in at least one state bar, with a preference for D.C.
• PHYSICAL / MENTAL / ENVIRONMENTAL REQUIREMENTS
• Requires sitting at a desk for extended periods of time; walking and standing for extended periods of time throughout the workday; use of a PC workstation for extended hours; lifting up to 20 pounds, and verbal communications with others. Occasional travel. Extended hours, including evening and weekends as needed.
